In Eshaghi v. Hanley Dawson Cadillac Co. the Illinois Supreme Court stated the essential role class actions play in protecting consumer rights:
"In a large and impersonal society, class actions are often the last barricade of consumer protection . . . To consumerists, the consumer class action is an inviting procedural device to cope with frauds causing small damages to large groups. The slight loss to the individual, when aggregated in the coffers of the wrongdoer, results in gains which are both handsome and tempting. The alternatives to the class action - private suits or governmental actions - have been so often wanting in controlling consumer frauds that not even the ardent critics of class actions seriously contend that they are truly effective. The consumer class action, when brought by those who have no other avenue of legal redress, provides restitution to the injured and deterrence to the wrongdoer."
Consumer rights are often hard to enforce and businesses are aware of that fact. Many businesses count on the trouble and expense of enforcing your rights to be prohibitive. They know many consumers will just "chalk it up to experience" and go on with their lives.
Sometimes when an individual is willing to fight, these companies will often give in after a while and attribute it to the expense of doing business. However, because the number of individuals willing to fight is relatively small, the businesses that violate your consumer rights will continue to thrive.
For this reason, the law permits class action lawsuits. Class action lawsuits allow for a lawsuit to be filed on behalf of a group of similarly situated people. Now those individual quarters and dollars that companies are ripping off consumers for can add up to hundreds of thousands and even millions of dollars.
These class action lawsuits are taken seriously by the companies they are filed against, as well as other companies engaged in the same tactics.
