Health Club and Dating Service Billing Practices and Fees

Many states require dating services and health clubs to allow consumers to cancel the contract before accepting payment and to disclose cancellation rights. If your health club or dating service did not provide for such cancellation rights, contact us.

Many states regulate health club and dating service initiation fees. A federal court in Allen v. Holiday Universal recently certified a class-action involving alleged excessive health club fees. If you believe you are the victim on excessive or unfair health club initiation fees, contact us.

The Fair and Accurate Credit Transactions Act protects consumers against identity theft. It forbids merchants from printing (a) more than the last 5 digits of the credit / debit card number; or (b) (a) the expiration date on your credit or debit card receipt. If your receipt contains more than the last 5 digits or your card number or the expiration date you are exposed to potential indentify theft. You can recover statutory damages of a minimum of $100 and a maximum of $1,000 per receipt against a merchant who willfully violated the law through intentional or reckless conduct. To obtain statutory damages, it is not necessary that you actually were the victim of identity theft or suffered damages. The law is designed to cause merchants to take the needed measures to protect customers from identity theft and punishes violators with an award of statutory damages to the consumer.

Unsolicited Junk Faxes

If you have received junk faxes that you didn't request during the past 4 years you may have a claim under Telephone Consumer Protection Act ("TCPA). The TCPA allows recipients of unsolicited junk faxes to file suit to recover fixed damages of between $500 for a violation that is a mistake up $1500 for a willful violation.

Courts in Illinois and across the country have certified class actions for violations of the Telephone Consumer Protection Act and Consumer Fraud Act. Senders of fax advertisements should not be able to foist the cost of their advertisements on consumers.
